Ride Sports ANZ Pty Ltd ABN 38 625 108 910 ("Ride Sports/us/we/our") offers delivery in respect of its products offered on the Ride Sports website: http://www.thok.com.au.
Your use of the Ride Sports website constitutes your acceptance of this delivery information.
Subject to law, Ride Sports may, in its discretion, from time to time amend or otherwise modify the delivery information. Ride Sports recommends you carefully read, each time you visit the website, the delivery information as it may affect your rights.
If you do not agree with the delivery information, do not use the website, order online or interact with us or our related bodies corporate at all.
All prices on the Australian website are displayed in Australian Dollars (AUD), and will be charged in Australian Dollars. Prices on the New Zealand website are displayed in New Zealand Dollars.
Within Australia and New Zealand
FREE shipping for all Thok E-bike orders which are to be shipped to:
· an Australian or New Zealand business address; or
· an Australian or New Zealand residential address; or
· a THOK pick up point.
For deliveries to a business or residential address, please note that the customer (or its authorised representative) must be available to sign for the delivery; Ride Sports will not accept an ‘Authority to Leave’. Please see ‘Acceptance of Delivery’ section below for further information.
Estimated shipping timeframes are as follows:
· for Australia: between 2 - 7 business days, depending on the state or territory of the nominated delivery address;
· for New Zealand, North Island: between 1 – 3 days for metropolitan areas;
· for New Zealand, South Island: between 5 – 15 days for metropolitan areas,
Please note that the above timeframes are only estimates and final timing is subject to local availability.
Once your order is shipped you will receive an email confirmation from Ride Sports with your shipping details and tracking information. If you have any trouble identifying your tracking number or freight provider, please e-mail our office for assistance.
Overnight or urgent deliveries can usually be arranged for an additional cost by contacting a Ride Sports Customer Service Representative at firstname.lastname@example.org. As noted, this is not a free service and substantial charges may be incurred. The Ride Sports Customer Service Representative will be able to provide quotes for overnight or urgent deliveries. You will be responsible for payment of the delivery costs for overnight or urgent deliveries.
Overseas orders, excluding New Zealand orders, cannot be processed online. If you would like to place an order and have it shipped internationally, please contact one of our customer service representative by e-mailing email@example.com. Offshore deliveries will attract shipping charges and delivery times will be longer, depending on the delivery location (see above for New Zealand shipping charges and estimated delivery times). In addition, any customs, duty charges or additional local shipping charges incurred at the port of entry are the responsibility of the customer, not Ride Sports.
Ride Sports will use reasonable endeavours to ensure its delivery agents meet delivery estimates. However, Ride Sports cannot be held liable for any delay in delivery.
The products are at the customer’s risk once delivered.
If the customer chooses to have Thok E-bike products shipped to them, the Thok E-bike will be delivered partially assembled and the customer will be responsible for completing any final assembly/adjustments in accordance with any instructions/manuals provided. Please note; minor assembly is required. Ride Sports recommends that the customer engages, at its sole expense, a skilled mechanic to assist with the final assembly process.
Once delivered, products are assembled, used and stored at the customer’s own risk. Ride Sports will not be liable for any damage, loss or disruption caused by the same.
Alternatively, the customer can opt to collect the Thok E-bike from a Thok pick-up point, where a skilled mechanic can complete the final assembly/adjustments for the customer.
Acceptance of Delivery
You agree to comply with the following delivery requirements and such other requirements that we notify you of when you place your Order through the Ride Sports website:
· An appropriate person must be present to accept the delivery of your Order.
· We may require the person accepting the delivery of your Order to:
o provide us with proof of that person’s identity (including photographic identification) and, where relevant, age;
o if the Order has been paid by credit card, then we may also ask you to show us the credit card for us to conduct our verification checks; and
o where relevant, provide us with proof that the consents referred to under the restricted products section of the Terms and Conditions have been obtained.
· If there is no appropriate person (for example, above 18 years old for restricted products) at the delivery address to receive the Order or you are unable to show us the credit card for us to conduct verification checks, then we will not deliver the products you have ordered.
· acknowledge and agree that any person at the delivery address who receives the products is authorised by you to receive your Order; and
· will ensure that, in the case of restricted products, the person authorised by you to receive your Order is over the required age as prescribed by law or as otherwise set out in these terms and conditions.
We will not deliver a restricted product to a person who is unable to prove that he or she is over the required age as prescribed by law or as otherwise set out in these terms and conditions. In this instance, we may endeavour to contact you to arrange for delivery at a different time (you may be charged an additional delivery fee for that re-delivery), or we may cancel the order and refund any amounts paid for that order under these terms and conditions (excluding the delivery fee).
If (i) the customer (or its authorised representative) will not or does not accept delivery when the products are ready for delivery or (ii) Ride Sports or its agent cannot effect delivery because Ride Sports or its agent considers at the time of delivery that delivery would be hazardous or would be contrary to their policies, industry practice or statutory requirements or (iii) because the customer has not provided Ride Sports with appropriate instructions, documents, licences or authorisations to properly, legally and safely effect delivery of the products, risk in the products passes to the customer, the products will be deemed delivered, and Ride Sports may store the products until actual delivery, in which case, the customer will be liable to Ride Sports for all related costs, such as re-delivery charges, storage and insurance.
